These Terms and Conditions (“Terms”) govern your access to and use of SaferAI’s services, content, programs, workshops, resources, and website (collectively, the “Services”). By engaging SaferAI, booking a workshop, accessing materials, or using our website, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use SaferAI’s Services.

1. About SaferAI

SaferAI provides education-focused professional development, student workshops, advisory services, and resources relating to artificial intelligence (AI), digital literacy, ethics, and safe and responsible AI use.

SaferAI operates in Australia and delivers services both in-person and online.

2. Nature of Services

SaferAI’s Services are educational and advisory in nature only.

SaferAI does not:

- Provide legal advice
- Provide regulatory compliance certification
- Guarantee compliance with any specific law, policy, or governing authority
- Replace professional legal, policy, or technical advice

All information provided is general in nature and must be interpreted and applied by the client in their own institutional, legal, and policy context.

3. No Guarantees or Outcomes

SaferAI does not guarantee:

- Behavioural change in students, staff, or institutions
- Compliance with school, state, or federal policies
- Prevention of academic misconduct or misuse of AI
- Specific learning outcomes or performance improvements

Education involves human judgement, context, and behaviour.

SaferAI provides frameworks, guidance, and training — not enforcement or control.

4. Client Responsibilities

Clients are responsible for:

- Ensuring Services are suitable for their context
- Interpreting and implementing guidance appropriately
- Ensuring compliance with all relevant laws, regulations, and education authority policies
- Supervising students and staff during and after workshops
- Making independent decisions regarding AI use, assessment design, and policy

SaferAI is not responsible for how advice or information is implemented or misapplied.

5. AI-Related Limitations and Risks

SaferAI acknowledges — and explicitly teaches — that AI tools:

- May generate inaccurate, biased, incomplete, or misleading outputs
- Should not be treated as authoritative sources
- Require human judgement, verification, and oversight

SaferAI is not responsible for:

- Decisions made using AI tools
- Reliance on AI outputs by students or staff
- Data entered into third-party AI platforms
- Changes in AI capabilities, policies, or behaviour over time

6. Intellectual Property

All SaferAI materials, including but not limited to:

- Workshop content
- Slides, handouts, frameworks, diagrams
- Training materials
- Digital resources
- Written, visual, or recorded content

are the intellectual property of SaferAI unless otherwise stated.

You may:

Use materials internally within your organisation
Share materials with participants for educational purposes

You may not:

- Reproduce materials for commercial use
- Sell, license, or redistribute content
- Claim SaferAI materials as your own
- Record workshops without written permission

7. Recording and Use of Sessions

Workshops may be recorded by SaferAI for:

- Quality assurance
- Internal training
- Resource development

Clients must obtain written consent before recording any SaferAI session.

SaferAI will not record students without appropriate consent where required by law.

8. Privacy and Data

SaferAI does not knowingly collect personal data from students beyond what is reasonably necessary for service delivery.

Clients are responsible for:

- Ensuring compliance with privacy laws
- Obtaining required consents
- Ensuring no sensitive, personal, or health data is entered into AI tools during sessions

SaferAI is not responsible for data shared with third-party platforms.

9. Third-Party Platforms

SaferAI may reference or demonstrate third-party platforms (e.g. AI tools, educational software).

SaferAI:

- Does not own or control these platforms
- Is not responsible for their availability, accuracy, or data practices
- Does not endorse any specific tool unless explicitly stated

Use of third-party tools is at the client’s own risk.

10. Fees, Bookings, and Cancellations

Fees are agreed prior to service delivery.

Unless otherwise stated:

- Bookings are confirmed upon payment or written agreement
- Cancellations within 7 days of delivery may incur a fee
- Late cancellations or no-shows may be charged in full

Rescheduling is subject to availability.

11. Limitation of Liability

To the maximum extent permitted by law, SaferAI is not liable for:

- Indirect or consequential loss
- Loss of data, reputation, or opportunity
-Academic, disciplinary, or regulatory outcomes
-Misuse or misunderstanding of AI tools
-Actions taken by students, staff, or institutions

Total liability, where permitted, is limited to the amount paid for the relevant service.

12. Indemnity

You agree to indemnify SaferAI against any claims, losses, or damages arising from:

- Your use of the Services
- Your implementation of advice
- Breach of these Terms
- Use of AI tools following training

13. Changes to Services and Terms

SaferAI may update:

- Services
- Content
- These Terms

Continued use of Services constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of Australia.

Any disputes shall be subject to the jurisdiction of Australian courts.
